DishNFold/Maze LLC – Terms and Conditions

Effective Date: April 17, 2025


PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR PLATFORM. YOUR ACCESS TO AND USE OF THE SERVICE IS CONDITIONED ON YOUR ACCEPTANCE OF AND COMPLIANCE WITH THESE TERMS. THESE TERMS APPLY TO ALL VISITORS, USERS (BOTH CLIENTS AND HOUSE HELPERS), AND OTHERS WHO ACCESS OR USE THE SERVICE.

By accessing or using the Service provided by DishNFold – A Maze LLC ("DishNFold," "we," "us," "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, then you may not access the Service.


1. Definitions

  • "Platform": Refers to the website(s), mobile application(s), and associated services owned and operated by DishNFold that facilitate the connection between Clients and House Helpers.
     
  • "User": Any individual who registers an account on the Platform, including Clients and House Helpers.
     
  • "Client": A User seeking household chore assistance services through the Platform.
     
  • "House Helper": A User offering household chore assistance services to Clients through the Platform. House Helpers operate as independent contractors.
     
  • "Services": The household chore assistance services (e.g., cleaning, laundry, tidying, errands as agreed upon) requested by a Client and agreed to be performed by a House Helper.
     
  • "Booking": An agreement made via the Platform between a Client and a House Helper for the provision of specific Services at a designated time and location.
     
  • "Service Fee": The amount charged by the House Helper for the Services provided, as displayed on the Platform.
     
  • "Platform Fee": The fee charged by DishNFold.com to Users (either Client, House Helper, or both) for using the Platform to facilitate a Booking. This may be included in the total price displayed or charged separately.
     
  • "User Content": Any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Platform provided by Users (e.g., profiles, reviews, messages).
     

2. Nature of the Platform – IMPORTANT ACKNOWLEDGEMENT

  1. Marketplace Only:  DishNFold provides a technology platform that connects Clients seeking household services with independent House Helpers offering such services.
    DishNFold/Maze LLC is not an employer of House Helpers nor a direct provider of household services.
     
  2. Independent Contractors:  All House Helpers using the Platform are independent contractors. They are not employees, agents, joint venturers, or partners of DishNFold. House Helpers control the manner and means by which they perform the Services. DishNFold/Maze LLC does not supervise, direct, or control a House Helper’s work or the Services performed.
     
  3. No Endorsement:  While the Platform may facilitate connections and provide tools like profiles and reviews, DishNFold/Maze LLC does not endorse, guarantee, or warranty the quality, safety, suitability, or legality of the Services provided by House Helpers or the accuracy of information provided by any User. We do not perform background checks on all users unless explicitly stated as part of a specific verification process (see Section 7). Any decisions by Users to offer or accept Services are made in their sole discretion.
     

3. Eligibility and Account Registration

  1. Eligibility:  To use the Platform, you must be at least 18 years old and capable of forming a legally binding contract. By using the Platform, you represent and warrant that you meet these requirements.
     
  2. Account Creation:  You must register for an account to access certain features. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
     
  3. Account Security:  You are responsible for safeguarding your account password and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
     

4. Bookings and Service Agreements

  1. Client Requests:  Clients may request Services by submitting a Booking request through the Platform, specifying the desired tasks, date, time, location, and estimated duration.
     
  2. House Helper Acceptance:  House Helpers may review available Booking requests and choose to accept them based on their availability and willingness to perform the requested Services.
     
  3. Service Agreement:  A legally binding agreement for the Services is formed directly between the Client and the House Helper once a House Helper accepts a Client's Booking request via the Platform. DishNFold/Maze LLC is not a party to this agreement.
     
  4. Modifications:  Any changes to the scope, timing, or other details of a Booking must be mutually agreed upon by the Client and the House Helper, ideally documented through the Platform's messaging system.
     

5. Client Obligations

  1. Accurate Information:  Provide accurate and complete details regarding the Services needed, the location address, and any specific instructions or requirements.
     
  2. Safe Environment:  Ensure the designated work location is safe and free from known hazards. This includes securing pets that may interfere with the Service or pose a threat, informing the House Helper of any potential dangers (e.g., broken fixtures, known allergens), and generally maintaining a safe environment compliant with applicable laws.
     
  3. Access:  Provide timely access to the property as agreed upon for the Booking.
     
  4. Necessary Supplies/Equipment:  Clearly communicate whether the Client or the House Helper is responsible for providing cleaning supplies and equipment for the specific Booking. If the Client is providing them, ensure they are available, safe, and functional.
     
  5. Respectful Treatment:  Treat House Helpers with courtesy and respect.
     
  6. Payment:  Pay all applicable fees (Service Fee and Platform Fee) for Bookings made through the Platform in accordance with Section 8.
     

6. House Helper Obligations

  1. Service Performance:  Perform agreed-upon Services professionally, diligently, skillfully, and to a reasonable standard of quality.
     
  2. Professional Conduct:  Maintain a professional and courteous demeanor when interacting with Clients and representing themselves through the Platform.
     
  3. Punctuality and Communication:  Arrive on time for scheduled Bookings and communicate promptly with Clients regarding any delays or issues.
     
  4. Accurate Representation:  Ensure their profile information, skills, and qualifications listed on the Platform are accurate and up-to-date.
     
  5. Compliance with Laws:  Comply with all applicable local, state, and federal laws and regulations related to their provision of Services.
     
  6. Independent Contractor Status:  Acknowledge and agree they are independent contractors responsible for their own taxes (income, self-employment, etc.), insurance (liability, workers' compensation if applicable), business licenses, and expenses. DishNFold/Maze LLC will not withhold taxes or provide any benefits.
     
  7. Necessary Supplies/Equipment:  Clearly communicate whether the Client or the House Helper is responsible for providing cleaning supplies and equipment for the specific Booking. If the House Helper is providing them, ensure they are safe, appropriate, and functional.
     

7. Background Checks (Optional – Customize based on your process)

  1. Process:  DishNFold/Maze LLC uses third-party services Checkr.com or Care Check to validate background checks as a courtesy. The scope of these checks will be communicated during the process and will be marked on the profile of the service provider.
     
  2. Limitations:  Users acknowledge that background checks are based on available public records at a specific point in time and are not foolproof. They do not guarantee a User's future conduct. DishNFold/Maze LLC relies on the accuracy and completeness of information provided by the User and the third-party screening service.
     
  3. Disclaimer:  DishNFold/Maze LLC disclaims any liability for the accuracy, completeness, or timeliness of background check information or for any reliance placed on such information by Users. Passing a background check does not constitute an endorsement by DishNFold/Maze LLC.
     

8. Payment Terms

  1. Fees:  Clients agree to pay the total fees displayed at the time of Booking, which include the House Helper's Service Fee and any applicable Platform Fees and taxes.
     
  2. Payment Processing:  DishNFold/Maze LLC facilitates payments through a third-party payment processor. By providing payment information, you authorize us (and our processor) to charge the applicable fees.
     
  3. Payment Flow:  Clients are typically charged upon confirmation of a Booking or completion of the Service, as specified during the Booking process. Funds (minus the Platform Fee) are disbursed to the House Helper according to a separate payment schedule outlined to Helpers (e.g., within X days of confirmed Service completion).
     
  4. Cancellations and Refunds:
     
    • Our cancellation policy [Link to separate Cancellation Policy or detail here – e.g., specifying deadlines for free cancellation, fees for late cancellation by Client or Helper].
       
    • Refunds are handled on a case-by-case basis, considering the circumstances and the cancellation policy. Disputes regarding Service quality should first be addressed between the Client and Helper (see Section 10). DishNFold/Maze LLC may, in its sole discretion, offer credits or refunds.
       

  1. Taxes:  Users are solely responsible for determining their own tax reporting requirements. House Helpers are responsible for paying their own income and self-employment taxes. DishNFold/Maze LLC may charge sales tax or VAT on its Platform Fees where legally required.
     

9. Insurance

  1. House Helper Responsibility:  House Helpers acknowledge they are independent contractors responsible for obtaining and maintaining appropriate insurance coverage for their business operations, including general liability insurance, and, if applicable, workers' compensation insurance. DishNFold/Maze LLC does not provide insurance coverage for House Helpers.
     
  2. Client Responsibility:  Clients are responsible for maintaining appropriate insurance for their property (e.g., homeowner's or renter's insurance) that may cover damages or incidents occurring on their premises.
     
  3. Platform Disclaimer:  DishNFold/Maze LLC does not carry insurance covering loss, damage, or injury caused by Users during the provision or receipt of Services. Users interact and transact at their own risk.
     

10. Disputes Between Users

  • Clients and House Helpers agree to first attempt to resolve any disputes regarding Services (e.g., quality, damages, timeliness) directly and in good faith.
     
  • Users may report unresolved disputes to DishNFold/Maze LLC. We may, but are not obligated to, facilitate communication or offer non-binding mediation to help resolve the issue.
     
  • DishNFold/Maze LLC is not responsible for resolving disputes between Users and is not liable for any claims, demands, or damages arising out of such disputes. We reserve the right, but have no obligation, to monitor disputes.
     

11. User Conduct and Content

  1. Prohibited Activities: You agree not to use the Platform to:
     
    • Violate any laws or regulations.
       
    • Infringe upon the rights of others (intellectual property, privacy, etc.).
       
    • Post false, misleading, defamatory, or fraudulent information.
       
    • Harass, threaten, discriminate against, or harm any other person.
       
    • Engage in unsafe or illegal activities during the provision or receipt of Services.
       
    • Circumvent the Platform by arranging Bookings or payments outside of it after being connected through it, in order to avoid Platform Fees.
       
    • Distribute spam or unsolicited commercial communications.
       
    • Damage, disable, overburden, or impair the Platform.
       

  1. User Content: You grant DishNFold/Maze LLC a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use, copy, modify, distribute, publish, and process User Content you provide through the Platform (e.g., profile info, reviews) for the purposes of operating and promoting the Platform, without any further consent, notice, or compensation to you or others. You are solely responsible for your User Content.
     

12. Intellectual Property

  • The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of DishNFold/Maze LLC and its licensors, protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
     

13. Privacy

  • Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and disclose information. By using the Platform, you consent to the practices described in the Privacy Policy.
     

14. Disclaimers

  • THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DishNFold/Maze LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
     
  • WE MAKE NO WARRANTY THAT:
    (A) THE PLATFORM OR SERVICES WILL MEET YOUR REQUIREMENTS;
    (B) THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
    (C) THE RESULTS OBTAINED FROM THE USE OF THE PLATFORM (INCLUDING THE QUALITY, RELIABILITY, SAFETY, OR SUITABILITY OF HOUSE HELPERS OR SERVICES) WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS; OR
    (D) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE PLATFORM WILL MEET YOUR EXPECTATIONS.
     
  • DishNFold/Maze LLC IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE PLATFORM OR FOR ANY SERVICES PROVIDED. YOU USE THE PLATFORM AND ENGAGE IN SERVICES AT YOUR OWN RISK.
     

15. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall DishNFold/Maze LLC, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • (A) Your access to or use of or inability to access or use the Platform;
     
  • (B) Any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other Users or third parties;
     
  • (C) Any content obtained from the Platform;
     
  • (D) Unauthorized access, use, or alteration of your transmissions or content;
     
  • (E) The Services provided or received through the Platform, including any property damage, personal injury, or other harm resulting therefrom; or
     
  • (F) Any other matter relating to the Platform or Services.
     

In no event shall the aggregate liability of DishNFold/Maze LLC exceed the greater of one hundred U.S. dollars ($100) or the amount you paid DishNFold/Maze LLC, if any, in the past six months for the Services giving rise to the claim. The limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not DishNFold/Maze LLC has been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

16. Indemnification

You agree to defend, indemnify, and hold harmless DishNFold/Maze LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, your User Content, any use of the Platform's content, services, and products other than as expressly authorized in these Terms, your provision or receipt of Services, or your interaction with any other User.

17. Termination

  • We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
     
  • If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
     
  • All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Outstanding payment obligations shall also survive termination.
     

18. Modifications to Terms

  • We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect (e.g., via email or a notice on the Platform). What constitutes a material change will be determined at our sole discretion.
     
  • By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
     

19. Governing Law and Jurisdiction

  • These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
     
  • You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Santa Clara County, California to resolve any dispute or claim arising from these Terms or the Service.
     

20. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and DishNFold/Maze LLC regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
     
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
     
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
     
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
     
  • Notices: Any notices or other communications permitted or required hereunder will be in writing and given by DishNFold/Maze LLC via email (to the address associated with your account), posting to the Platform, or other reasonable means.
